A formal request for LA Secretary of State’s investigation of Jindal’s official Rand Paul statement

The text of my email message sent today to the Louisiana Secretary of State’s office:

Dear Mr. Ardoin:

Article XI sec 4 of the Louisiana Constitution prohibits the use of public resources to support or oppose a candidate for public office: 

“No public funds shall be used to urge any elector to vote for or against any candidate or proposition, or be appropriated to a candidate or political organization. This provision shall not prohibit the use of public funds for dissemination of factual information relative to a proposition appearing on an election ballot.”

The prohibition has been placed in statute La. R.S. 18:1465 and it articulates the penalty for violating this law:
 

§1465.  Prohibited use of public funds

A.  No public funds shall be used to urge any elector to vote for or against any candidate or proposition, or be appropriated to a candidate or political organization.  This provision shall not prohibit the use of public funds for dissemination of factual information relative to a proposition appearing on an election ballot.

B.  Whoever violates any provision of this Section shall be fined not more than one thousand dollars or be imprisoned, with or without hard labor, for not more than two years, or both.

On May 27, 2015, Gov. Bobby Jindal issued the following press statement, using his official press office within the Governor’s Office:

Given the fact that is it very likely Gov. Jindal and his staff members have violated not only the state’s constitution, but also La. R.S. 18:1465, I am requesting that this matter be referred to and investigated by your office’s Election Compliance Unit for possible presentation to the appropriate district attorney’s office.

    By the way, nothing will come of this. Is it even possible to consider a Louisiana District Attorney, even a Democrat like Hillar Moore, taking on the governor?

    YOU took him on. C.B. Forgotston took him on. Tom Aswell took him on. All the people who comment on blogs and the newspaper comment boards take him on daily. These media may not have the force of law and we can’t put him behind bars where he belongs. But your courage and the others who also speak truth to power will ensure that jindal does in fact get the reward he richly deserves – relegation to the trashheap of history.

      Thanks for that. Many other have taken him on, as well. And I do think that the reason he’s stuck at 1 percent in the polls is that people outside Louisiana have gradually gotten the message that he’s nothing but a cheap demagogue and an outrageous phony.

    And the more people know about Jindal, the less they like him. Louisiana people woke up too late. The rest of the world saw him for what he really is right out of the gate.

    Thanks for notifying officials of the breaking of Article XI:4 by the governor. He is not the only one. The Winn Parish Police Jury placed an ad in the Winn Parish newspaper ( see copy of ad at :https://lincolnparishnewsonline.wordpress.com/page/5/) (3rd article down on the page) urging a vote for a tax proposal using tax monies to pay for the ad.
    I have notified some of the same officials that you have as well as the election commissioner and attorney general, of this violation by the Police Jury. As far as I know nothing has been done. Now we have a new tax that , in my opinion, should be declared null and void because of the jury’s breaking the law.
